An attempted murder charge filed against Raymond Delagarza, 29, Decorah, has been dismissed because his victim was killed in a Dec. 4 car accident in Bremer County.
Delagarza was accused of intentionally attempting to cause the death of a Decorah woman July 18, committing domestic assault with intent to inflict serious injury and harassing and threatening to commit a forcible felony.
In Winneshiek County District Court recently, a judge granted a motion to dismiss the case. After the death of the victim, County Attorney Andy Van Der Maaten said there was insufficient evidence to convict the defendant.
Delagarza also was charged with assault causing serious injury and assault in violation of individual rights for allegedly knocking Abdikani Aden of South Sioux City, Neb. unconscious in the Decorah Mart parking lot July 22.
Court records said Delagarza hit Aden again, twice in the head, while he remained unconscious. The assault caused Aden a "protracted loss and impairment of his motor function and his mental capacity," records stated.
The charges involving the assault on Aden were dismissed in September because Aden was not available for trial.
